Six Federations and Unions including employees of EYDAP and EYATH, as well as 20 residents against the Joint Ministerial Decision
The issue of pricing is once again under the “microscope” of the Council of the Territory water after an appeal was filed requesting that the relevant joint ministerial decision be annulled as unconstitutional and contrary to European and Greek legislation.
Six Federations and Unions, including employees of EYDAP and EYATH, as well as 20 residents who are against the
from 26.9.2024 onwards for “determining the general rules for costing and invoicing water services, improvement measures, procedures and cost recovery method of water services in its various uses”.
In their appeal, among other things, they argue that the constitutionally mandated public and municipal pricing control of the public vital service is weakened, with the consequence that “uncertainty is caused as to the continuation of their provision under public service conditions, i.e. with security, universality, high quality and affordable price”.
According to the applicants with the co. “a purely accounting pricing policy is adopted, which applies indiscriminately to the whole country, regardless of the particular characteristics of each river basin.” as they note “only the establishment of the regulation on the way of calculating the environmental cost and the cost of the resource based on the data resulting from the currently applicable river basin management plan, as well as individual forecasts that also incorporate environmental or social criteria, are not sufficient in order to consider that the overall regulation established by the contested decision meets, in a systematic and coherent manner, the above-mentioned requirements of the directive and the national legislation”, as the Council of State has already judged since 2022.
